a man was standing on the corner of foothill boulevard and 36th avenue and the driver of the stolen jeep smashed into another car at the intersection where he was standing. the driver of the jeep died. the driver of the honda suffered minor injuries and somehow the man who was standing on the street managed to its scrape without getting hurt. the jeep was stolen minutes earlier. >> a woman and two children are expected to survive after being hit by a car in pittsburg last night. police have not said what led to the crash or if the driver was arrested. one of the children was airlifted to the hospital. police have not released the victim names or conditions. >> study ranges traffic in the bay area among the worst in the nation. the report from texas texas a&m shows san francisco is tied

with los angeles but washington, dc is at the top the list. cornell bernard will break down the new report including how much time you spend in traffic. >> hearing date is set for barry bond whose is appealing his conviction on obstruction of justice with oral arguments tomorrow in san francisco. the judges were appointed by three different democratic presidents. bonds was convicted in 2012 of giving misleading testimony to a federal grand require about whether he used performance-enhancing drugs. >> after a week on edge a small alabama town is resting this morning after federal agents raided a cramped bunker where a five-year-old boy was being held hostage. the captor was killed. we have details for you on how the boy is doing this morning.

>> good morning, kristen. exactly a week ago that insent little boy was snatched and held captive but this morning the best possible news: he is safe. we are told he is doing well. >> the little boy held captive for seven days is safe. he seen in this photograph celebrates his sixth birthday tomorrow surrounded by family and taken to a hospital for treatment and said physically unharmed. >> he is laughing, joking, playing, eating, and the things you would expect a normal five to six-year-old young man to do. >> the suspect, 65-year-old is dead after f.b.i. agents stormed the bumper. authorities inserted a high-tech camera in the bunker and monitored his movement. they went in using an explosive and neutralized him after becoming increasingly concerned he could act out. mr. dikes was observed holding a

gun and at this point the f.b.i. agents fearing the child was in imminent danger, entered the bunker and rescued the child. the terrifying stand off began last tuesday when he boarded a school bus and shot and killed the bus driver and snatched the boy who was held captive in a 6 by 8' underground bunker. the swat teams negotiated through ventilation pipe and law enforcement flew drones over looking for signs the boy was alive. authorities handled the situation slowly in order to keep the boy safe. >> you have to be extremely careful because any sort of device you might use against him could obviously harm the boy because he is right there. >> interest in the stand off extended beyond alabama and president obama praised authorities for saving the little boy.

>> thank you. a pair of suspected thieves face charges for using information from a contra costa newspaper list to burglarize a home in walnut creek while the owners were vacation similar to an incident involving the "los angeles times" where they took $1 million in valuables while people were on vacation based on a "los angeles times" delivery hold list. police believe an office machine repairman leaked the list and the contra costa times is trying to determine how the information was released. >> i have to get gas and i did not even need to put on a jacket. >> it is milder this morning. mike? >> you bigoted -- you big teddy bear. >> they are right. it is milder because of the

other and now it is partly blocking the industrial off-ramp from southbound 680. if you are traveling out of antioch, the highway four bypass, this is slowing and it picks up from pittsburg to the concord area westbound four. sluggish out of the central valley with speeds picking up over the altamont pass and 20-minute drive from altamont pass to dublin/pleasanton entrepreneur. the bay bridge toll plaza, no problems here and traffic is light on the upper deck. >> thank you. next, bay area prosecutors go after a multinational oil company for failing to protect the local environment. the damage they claim it is doing is ahead. >> former coach reaching a deal with a university on his firing and what it will cost the school.

designed to protect the environment. b.p. suggests the attorney general is going after oil companies for money. the attorney general recently settled a similar case against chevron for $24 million and another case has been filed against union 76 stations. >> former cal football coach could be out of a job but he will not have to worry about bouncing checks, getting up to $5.5 million in a settlement agreement with the university. he was fired this season after posting a 3-9 record. he has been agreed to give him $1.6 million this year, $1.8 million next, and $1.95 million in 2015, the all time winningest coach over the 11 years with the team. >> in arizona controversial sheriff joe arpaio has become a victim of credit card fraud. investigators say the sheriff's credit card information was stolen and used to make a $300 transaction at a chicago grocery

the bay area is at the top three when it comes to the worst commutes. washington, dc area is number one. here is a look at exactly how it breaks down. that means drivers there wasted a total of 67 hours last year costing each of them almost $1,400. 61 hours and $1,300 in los angeles, and 61 hours and more than $1,200 in wasted time or wasted dollars for drivers in the san francisco and oakland area. we are tied with los angeles for terrible traffic. we are adapting. we are building delays into our commute, an hour for a trip that might take only on minutes without traffic. the study could be helpful for transportation bosses incentive to improve our freeways and keep the traffic moving. that is the hope. we are live in emeryville for

santa clara with more on the niners in a live report coming up in the next half hour. >> the bay area is hoping to win the bid to host the super bowl in 2016 at new 49ers stadium going up in santa clara. the san jose mercury news say fans will not see any blackouts at the new high-tech facility like they did at sunday's game, local leaders say there is no doubt that power will be a key topic on the mine of the owners when they pick a host city. there will be two new electrical substations but only one is needed. the niners are adding solar panels to provide extra power. >> san francisco is focusing on a sporting event of worldwide proportions, the risk -- olympics, creating a group to bring large scale shorting events to the bay area. the mayor said with the new

5:42. homeland security secretary napolitano tours the border with mexico in el paso, texas, promoting border security as congress takes up major immigration law reforms. the obama administration wants to streamline the citizenship process. a bipartisan group of senators is demanding assurances on border security first. napolitano says effective patrols have pushed illegal immigration numbers to the lowest level in 40 years. >> the national gun control debate started after hand hand and is now if los gatos, a gun store opened in december and drew a lot of opposition at a hearing last night. opponents complain a public review of the permit process for the company was not conducted although city officials were not required to. they are worried about the nearness to an elementary school. >> i heard of a store being opened that wear houses guns 2 ,000' from our school, around the corner. i felt a bit sick at heart.

each morning with an accident, hit and run accident northbound 101 off to the shoulder so it is not slowing in this area south of morgan hill. elsewhere, north 87 to north 280, 15 more minutes before it is wrapped up and not much slowing if that area. we will look at the walnut creek commute coming out of pleasant hill making the curve at north main to the 24 junction, traffic is moving nicely through the san ramon valley. >> it is now 5:47. state regulators say the tour bus form involved in the deadly crash was cited several times for safety violations. the accident killed seven passengers and 17 others are still in the hospital on sunday. the company that operated the bus had 22 safety violations during the inspections including brake and tire problems.
